The Consumer Product Safety Commission (CPSC) decided in 1997 that you cannot be trusted to handle the toys in a safe manner. They feel you might either give the small pieces to very young children or perhaps choke on them yourself.
Since this is the case they have instructed US Customs not to allow any more Kinder Surprise Eggs into the country. It does not seem to matter that you know of the hazzards of Kinder Eggs and that you want these for your own personal use. As such whole Kinder Eggs presently in the US are likely rare. Newer ones made since the decision will become rarer still. Canadian versions are likely the most common, and are made in Argentina. German versions are made in country and for the local market so are one of the rarest to find.
